Small Claims Court Case Types

Most cases for the recovery of money can be heard in small claims court. This could be an action to get your security deposit back, or an action to recover money for damage done to your vehicle after a car accident. However, small claims court cannot handle assignments of claims (where one person transfers their interest in an action to another), a divorce proceedings, and cases filed by collection agencies or agents.

Can I hire an attorney?

In Texas, small claims parties generally represent themselves without an attorney. The reasoning behind this is because the amount is $10,000 or less, hiring an attorney becomes cost prohibitive. Nevertheless, you are allowed to retain one if you desire. (Texas Government Code Section 28.003).

What is the trial like?

Small claims court trials are very informal compared to a regular civil trial. In fact, the judge in small claims court is charged with developing facts of the case and may question or summon witnesses. Furthermore, the judge is allowed and often ask questions of witnesses and parties to help understand the facts of a case. A small claims court trial is much quicker, often lasting between 15-20 minutes. A jury trial will likely last longer, probably a few hours. Limit (or Jurisdiction) of Small Claims Court

You cannot demand or ask for more than $10,000 in a small claims court case. (Government Code 28.093). Another restriction of small claims court is that a plaintiff can only seek monetary relief (an award of money). You are unable to seek injunctive or equitable relief. For example, if you pay a painter $1,000 to paint your house and the painter does not even begin, you cannot ask the court to issue an order for the painter to paint your house. This type of relief would be injunctive relief.

      I have a major problem: elder abuse, my age 63. Despite serious auto related injuries and lack of updated accounting skills, I was prevented from finding a financial job. My background is in MFG ACCOUNTING.

      She is a CNA; cares for elderly women still residing in their homes. She knows her actions are harmful, injurious. I NEED HELP.

      She denied me TV Access.
      She blocked my WIFI ACCESS: critical to successfully completing my MAJOR DARS approved projects, which is a MIRACULOUS ACHIEVEMENT. TO secure $9k of funding, includes a $900 HP laptop, a paid personal recruiter-job coach, and funding a CMA designation recertification ($800+)…Was AN ACHIEVEMENT WAY, WAY, WAY ABOVE AND BEYOND any reasonable expectation.

      She removed pans I used to cook.
      She prevents the kitchen and DR tables from being used.
      She is taking 2 weeks to take down all her Xmas decorations, up since Thanksgiving. These cover the entire home — 3 trees, 100+ candles, decorations reflect overkill times 3x.

      Removed all washing machine detergents, etc.

      STARTING to play games with central HVAC. It keeps getting warmer and warmer.

      Refuses to replace my window shade. The afternoon sun bakes my room. Old shade did not block out more than 70*% of sun.

      Allows neighbors dog to bark under my window. Decided not to complete in yard fencing, enabling neighbors dog to run free or to whine and bark …Close to my window. Dog has barked continuously from 7am til 8:30 pm.

      Told me she was diagnosed with bipolar, walked out on her psychiatrist, destroying the ABILIFY SCRIPT.

      Trained CNA, knows better.

      If looks could Kill, I’d be dead.
      I am trying to live here thru May. I need to get all my coursework done. Funds are tight.

I have a payment agreement from her promising to pay monthly the money but she moved to Washington and has stopped paying.
